Abstract Since the founding of new China in 1949, the status of women has greatly improved, and also has the pivotal status in the social production labor. With the development of the times, women in the process of social production plays a more and more important role. However, due to the effects of some feudal dross and objective reality, infringement of the rights and interests of women workers are common occurrences, already seriously affected the female workers in the social production enthusiasm and creativity. Although our country has this issue to be concerned and in the formulation and promulgation of relevant laws, still can not guarantee women workers rights of labor and employment. The labor and employment right is constitutional,which should be enjoyed by men and women equally. Women should be treated with indifference. Therefore, from the perspective of gender, this paper discusses the current situation of the labor rights and interests of women workers and the way to improve the conditions for female workers to seek more equality. In this paper, comparison of historical comparison and two international level, through historical comparison, that female worker labor employment rights and interests of the original advantages and characteristics, and to further implement the proposed legal system envisaged; through the international comparison, the legislative experience from foreign countries, seeking employment of female workers rights and interests of all countries
